Identify the change and its timing
Support modification generally involves a substantial change in either parent’s income and financial status or the child’s needs, with statutory filing restrictions and exceptions. I review the current order, the asserted change, and the evidence supporting the request.
The result is not predetermined
A job loss, higher earnings, or changed expenses may matter, but the amount can increase, decrease, or remain unchanged. Bring reliable records and a timeline rather than assume a particular event guarantees a particular adjustment.
Prompt advice can matter after income loss
After a significant involuntary income loss, seek advice promptly because service of a modification petition can affect available relief. A request to reduce future support does not itself erase arrears. Follow the existing order unless the court changes it, and bring any enforcement papers to the discussion.
Keep parenting requests separate
A custody or visitation issue may also need attention, but it uses different legal requirements. Explain both concerns at the outset so the proposed next steps address the actual issues.
